Key criteria as guarantors of legal certainty for contracts involving artificial intelligence systems

With the increasing development of IA, as well as, with its massive use, the absence of a clear regulation on the creation, execution and exploitation of the results of IA systems determines that the lex inter partes becomes even more important, especially to adequately distribute the risks inherent to IA and the uncertainty that surrounds it. Therefore, when drafting contracts involving IA, it is necessary to propose essential criteria for an analysis of their contents in order to strengthen their legal certainty. The research carried out has a qualitative approach, using applied research with descriptive and propositional advance and also addresses the issue from the national and international perspective, in order to process the information and discuss results, using as methods the analysis of documents, the interview, and following an exhaustive analysis guide, for the case study of a contract, in which the Central University Marta Abreu de las Villas is involved. From them, the main problems encountered in this type of contract will be identified, as well as the issues that should be improved to provide greater legal certainty to the parties involved.
